Understanding Tennessee Cemetery Law will focus on details of Tennessee Code Annotated 46-4 Termination of Use of Land as Cemetery, 46-8 Family Burial Grounds Protection and precedents set by the Walter Hines v. State of Tennessee (1911) decision along with other related codes. Tennessee cemetery statutes, which can lack clarity compared to those in neighboring states, can lead to varying interpretations, often leading to needless conflict and expensive resolutions. 

Graham Perry, the Tennessee Historical Commission’s Historic Cemetery Preservation Specialist, will explain these details to help make better sense of the current cemetery statutes. The overall goals of the program are to help participants to better navigate state law while offering solutions to existing cemetery-related problems that often arise affecting local governments, developers, landowners and family members alike.
